Terms of Service

Effective June 15, 2026

These Terms are the agreement between you and IMX Enterprises for using the Chemy app and this website. Please read them — by using Chemy, you agree to them.

1. Acceptance of these Terms

These Terms of Service (“Terms”), together with our Privacy Policy, form a binding agreement between you and IMX Enterprises (“we,” “us,” or “our”) governing your use of the Chemy application and chemyapp.com (together, the “Service”). If you do not agree, do not use the Service.

2. What the Service is

Contrails are ice-crystal clouds that form when hot, humid aircraft exhaust meets cold air at altitude; whether they persist depends on temperature, humidity, and wind. Chemy tracks real aircraft (public ADS-B), forecasts contrail conditions from atmospheric models, and lets you log sky observations. Chemy is not a medical device, not proof of any covert program, and not a substitute for official weather or aviation data. Community posts are user-generated and may contain speculation. The Field & Frequency Lab is for entertainment.

You agree not to rely on Chemy for navigation, aviation, weather, emergency, medical, or safety decisions.

3. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service, and old enough to form a binding contract. The Service is not directed to children under 13.

4. Your account

Chemy requires an account, created with Sign in with Apple. You are responsible for activity under your account and for keeping access to it secure. You may delete your account at any time — see Account & Data Deletion.

5. Community rules & acceptable use

Chemy includes user-generated content. We have zero tolerance for objectionable content and abusive behavior. When using community features, you agree that you will not post or do any of the following:

  • Name, identify, or target real individuals — pilots, crew, or any person. Posts may reference flight identifiers only (callsign, tail number, aircraft type).
  • Accuse a named airline, operator, or company of harmful, covert, or unlawful conduct. Discuss aircraft and conditions, not allegations against identifiable parties.
  • Defame, harass, threaten, impersonate, or invade the privacy of anyone.
  • Make medical, health, healing, or safety claims, or share dangerous misinformation.
  • Post hateful, violent, sexual, or otherwise objectionable content.
  • Post spam, scams, or unlawful content, or infringe anyone’s intellectual-property or other rights.
  • Upload malware, attempt to break security, scrape, or abuse the Service or its data providers.

Violating these rules may result in content removal and suspension or termination of your account.

6. Content you post

You retain ownership of the content you create. By posting, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and distribute that content within the Service so it can function (for example, showing your sighting on the community map). You represent that you have the rights to the content you post.

7. Moderation, reporting, and enforcement

Submitted content passes an automated filter and may be held for review before publication. Every post can be reported, and you can block other users. We review reports and aim to remove violating content within 24 hours. We may remove content and suspend or ban accounts at our discretion to enforce these Terms. To report content or a user, use the in-app Report control or email support@chemyapp.com.

8. Subscriptions and purchases

Chemy offers an optional premium subscription and may offer other purchases through Apple’s in-app purchase system. The free tier is usable without paying.

  • Price, billing term, and auto-renewal are shown before you buy.
  • Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
  • Manage or cancel anytime in iOS Settings → your name → Subscriptions. We cannot cancel an Apple subscription for you.
  • Payment is charged to your Apple account; Apple handles billing and refunds under its policies.
  • Use Restore Purchases in the App to recover purchases on a new device.

9. Marketplace and external links

The Cloudbuster Hub marketplace links to third-party sellers and is marketed as art, decor, and curio goods only — never as health, protective, or medical devices. Purchases happen on the seller’s own website, subject to their terms. We are not the seller and are not responsible for third-party goods, sites, or transactions.

10. Entertainment features

The Field & Frequency Lab — including the magnetometer visualizer, tone player, and space-weather panel — is provided for entertainment only. It is not a scientific instrument and makes no health, therapeutic, or protective claims.

11. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that data from third-party sources (including ADS-B, weather, and space-weather providers) is accurate, complete, or uninterrupted, and we do not control user-generated content.

12. Limitation of liability

To the fullest extent permitted by law, IMX Enterprises will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 50.

13. Indemnification

You agree to indemnify and hold harmless IMX Enterprises from claims arising out of your content, your use of the Service, or your violation of these Terms or the rights of others.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or other users.

15. Apple App Store terms

These Terms are between you and IMX Enterprises, not Apple, and Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the App. To the extent the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App, including product-liability, legal-compliance, or consumer-protection claims. You must comply with applicable third-party terms (for example, your wireless data agreement). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Changes to these Terms

We may update these Terms. We will update the “Effective” date above and, for material changes, provide notice in the App or on this site. Continued use after changes take effect means you accept the updated Terms.

17. Governing law

These Terms are governed by the laws of the United States and the state in which IMX Enterprises is established, without regard to conflict-of-laws rules, except where local consumer-protection law requires otherwise.
